Quiere Leibniz construir un cálculo lógico de un nuevo género, un cálculo formal que aporte rigor en los procedimientos demostrativos. A tal efecto considera necesaria una ampliación de la lógica tradicional. Frente a la organización apodíctica de Aristóteles, busca un nuevo método científico que no proceda sólo deductivamente desde una certeza expresada mediante axiomas, sino según una lógica heurística, y por lo tanto no clásica, que incluya un conjunto de procedimientos no silogísticos para inventar o producir nuevos conocimientos. Su idea (...) de una Ciencia General, es una planificación modular que consta de una multiplicidad de proyectos, cada uno de los cuales puede actuar separadamente, aunque en vistas a un único fin: su aplicación a la ciencia para aumentar el bienestar social de la humanidad. La formación docente es indispensable para responder a los requerimientos de la compleja sociedad actual. De su conocimiento, iniciativa, praxis y creatividad depende el éxito o el fracaso del sujeto que aprende. Al modificar el rol del docente se transforma la actitud de los estudiantes. ¿Cómo entender la formación filosófica transdisciplinar? Este texto responde a este y otros cuestionamientos: ¿cuáles son los planteamientos pedagógicos afines a la era digital? ¿en qué medida las TIC se encuentran al servicio de una filosofía (...) educativa transdisciplinar?, ¿cómo se explica ese enfoque en la formación del docente?, ¿cuál es la función de la formación en la innovación educativa?, ¿cómo formar para la ciudadanía mundial?, ¿cuáles son las contribuciones de las nuevas ciencias para la formación educativa? El crecimiento exponencial de la ciencia y de la tecnología nos obliga a pensar en procesos formativos innovadores. En tal sentido, resulta imprescindible el estudio de estas problemáticas. (shrink)

El objetivo de esta entrevista realizada el 11 de julio de 2021 a Óscar Sarlo, miembro de la Academia Nacional de Letras de Uruguay, consistió en detectar y comentar en qué estado se encuentra la capacidad de los ciudadanos de América Latina con respecto a la introducción del Derecho en distintos ámbitos sociales. El resultado de esa inserción es fructífero al hacer referencia a la producción literaria; sin embargo, también se trata de un ejercicio deleznable, tal como lo sigue desarrollando (...) la televisión nacional e internacional. En ese sentido, este trabajo permitió dilucidar cómo un tipo de audiencia está comprendiendo erróneamente y tergiversando la actividad jurídica. Ese malestar cultural también estaría justificado por el desconocimiento de las verdaderas funciones de las mismas instituciones que se encargan de impartir leyes y normas comunitarias. (shrink)

I argue that a standard formulation of hinge epistemology is host to epistemic relativism and show that two leading hinge approaches (Coliva’s acceptance account and Pritchard’s nondoxastic account) are vulnerable to a form of incommensurability that leads to relativism. Building on both accounts, I introduce a new, minimally epistemic conception of hinges that avoids epistemic relativism and rationally resolves hinge disagreements. According to my proposed account, putative cases of epistemic incommensurability are rationally resolvable: hinges are propositions that are the objects (...) of our belief-like attitudes and are rationally revisable in virtue of our overarching commitment to avoid systematic deception in our epistemic practices. I argue against the Standard View of ignorance, according to which ignorance is defined as equivalent to lack of knowledge, that cases of environmental epistemic luck, though entailing lack of knowledge, do not necessarily entail ignorance. In support of my argument, I contend that in cases of environmental luck an agent retains what I call epistemic access to the relevant fact by successfully exercising her epistemic agency and that ignorance and non-ignorance, contrary to what the Standard View predicts, are not (...) modal in the sense that knowledge is. After responding to objections, I conclude by sketching an alternative account of ignorance centered on the notions of epistemic access and epistemic agency. (shrink)

Entiendo la acción filosófica como un proceso doble de crítica axiomática y construcción teórica. Cuando esta acción se aplica a las construcciones simbólicas de nuestra identidad, la llamo mitopoética. Por motivos evidentes, este libro no puede sino aspirar a ser el bosquejo de un mapa epistemológico a gran escala de las narraciones de la identidad humana, esquema que he dividido en tres partes. En las dos primeras, defino una estructura conceptual que será utilizada en la tercera para desarrollar una teoría (...) de la acción mítica. La primera es una introducción general a los problemas de la mitología tal y cómo han sido tratados desde el punto de vista de la filosofía de la religión, la lingüística, la historia, la estética y la epistemología, fundiendo todos en un concepto más general de antropología filosófica. La segunda parte está dedicada a la definición de las emociones y a la comprensión de su centralidad en relación a la racionalidad y la estructura de los mitos. A partir de los procesos de desarrollo semántico-emocional del lenguaje, construyo una teoría de la racionalidad continua, en la que los ritos animales son entendidos como protomitos, y los rituales y mitos humanos como un desarrollo simbólico enario de unos protocolos generales de supervivencia. Ambas partes son, entonces, una discusión sobre los elementos conceptuales necesarios para comprender las estructuras mítico-rituales, definidas y tratadas en la tercera sección, en la que defino las propiedades de las acciones miméticas interpretativas, o acciones míticas, y examino las diferentes configuraciones que han tomado a lo largo de nuestro desarrollo simbólico. El libro concluye con un análisis de los condicionamientos generales para el desarrollo de futuras estructuras míticas. Mi punto de partida ontoepistemológico es evolucionista, emergentista y constructivista, una postura que queda mejor expresada a partir de la teoría de la racionalidad continua, de inspiración aristotélica, que parte de que los procesos vitales muestran -en diferentes estados de complejidad- la propiedad de la inteligencia. Este artigo apresenta um quadro conceitual para examinar a questão do especismo. Começa definindo-o como a consideração ou tratamento desfavorável injustificado daqueles que não pertencem a uma determinada espécie. A seguir, esclarece alguns dos mal-entendidos comuns acerca do que é e do que não é o especismo. Depois disso, argumenta contra a confusão entre (1) os diferentes modos em que se pode defender o especismo; e (2) as diferentes posições que assumem o especismo como uma de suas premissas. Dependendo se (...) essas últimas aceitam ou não outros critérios para a consideração moral à parte do especismo, podem ser posições especistas simples ou combinadas. Mas o especismo segue sendo em todos os casos a mesma ideia. Finalmente, este artigo examina o conceito de antropocentrismo, que define como o tratamento ou consideração desfavorável daqueles que não são membros da espécie humana. O conceito de antropocentrismo difere do de especismo e do de misoteria (animadversão para com os animais não humanos). Não obstante, pode-se concluir que o antropocentrismo é uma forma de especismo, à luz do que indicam, entre outros, o argumento da sobreposição de espécies e o argumento da relevância. (shrink)

In having an experience one is aware of having it. Having an experience requires some form of access to one's own state, which distinguishes phenomenally conscious mental states from other kinds of mental states. Until very recently, Higher-Order (HO) theories were the only game in town aiming at offering a full-fledged account of this form of awareness within the analytical tradition. Independently of any objections that HO theories face, First/Same-Order (F/SO) theorists need to offer an account of such access to (...) become a plausible alternative. My aim in this paper is twofold. In the first place, I wish to widen the logical space of the discussion among theories of consciousness by offering a distinction, orthogonal to that between F/SO and HO theories, between what I will call 'Self-Involving' (SI) and 'Mental-State-Involving' (MSI) theories and argue in favor of the former one. In the second place, I will present the basics of a characterization of such a Self-Involving theory in Same-Order terms. (shrink)

This article examines and rejects the view that nonhuman animals cannot be recipients of justice, and argues that the main reasons in favor of universal human rights and global justice also apply in the case of the international protection of the interests of nonhuman animals. In any plausible theory of wellbeing, sentience matters; mere species membership or the place where an animal is born does not. This does not merely entail that regulations of the use of animals aimed at reducing (...) their suffering should be implemented. It actually supports the end of such use, as well as other positive steps to provide help and to promote what is good not only for domesticated animals, but also for those living in the wild. Another reason to bring the protection of animals' interests into the international arena is that it is at this level that numerous animal exploitation industries enjoy the protection of different agreements and institutions. It does not follow from this that changing international law should be animal advocates' first priority, but it does follow that they should conduct their work internationally and not limit it to their own countries. Recent experimental studies indicate that epistemically irrelevant factors can skew our intuitions, and that some degree of scepticism about appealing to intuition in philosophy is warranted. In response, some have claimed that philosophers are experts in such a way as to vindicate their reliance on intuitions—this has become known as the ‘expertise defence’. This paper explores the viability of the expertise defence, and suggests that it can be partially vindicated. Arguing that extant discussion is problematically imprecise, we will finesse the (...) notion of ‘philosophical expertise’ in order to better reflect the complex reality of the different practices involved in philosophical inquiry. On this basis, we offer a new version of the expertise defence that allows for distinct types of philosophical expertise. The upshot of our approach is that wholesale vindications or rejections of the expertise defence are shown to be unwarranted; we must instead turn to local, piecemeal investigations of philosophical expertise. Lastly, in the spirit of taking our own advice, we exemplify how recent developments from experimental philosophy lend themselves to this approach, and can empirically support one instance of a successful expertise defence. Considering the war context and the emergence of the avant-garde in the early twentieth century, I base on this work the reasons why the presence of the concept of nivola, attributed by Miguel de Unamuno to refer to the literary technique used in his novel Mist (1914), provokes a possible confrontation between universes composed of elements of reality and the virtual. In that sense, it will be appropriate to explain the procedure that originates that collision of established plans. Whipple disease is a rare, infectious, disease first described from a single case by Whipple in 1907. As well as characterising the clinical and pathological features of the condition, Whipple made two suggestions regarding its aetiology. These were either than the disease was caused by an infectious agent, or that it was of metabolic origin. As the disease is now thought to be caused by infection with the bacterium Tropheryma whipplei, historical reviews of the history of the disease typically mention (...) only the first of these suggestions. In this paper, we therefore revisit Whipple’s other theory. We argue that a diverse and often successful research programme was developed around this mechanism of disease causation which gave rise to many useful findings on the condition. In the later parts of this article, we then turn to discuss the surprising neglect of this period of Whipple disease research in the current literature, and conclude by offering a brief reconstruction of this early history suitable for use in a technical context. Existen conceptos clave en las diversas ciencias (ya sean formales, naturales, biosociales o sociales) como “teoría” o “modelo” que están aún hoy sujetos a un amplio debate epistemológico, i.e. desde la teoría del conocimiento, y centrada en el estudio del conocimiento científico en particular. Los científicos, pues, construyen y utilizan diferentes nociones que cargan tras de sí realmente con un exhaustivo debate extracientífico sobre su naturaleza. En este trabajo se ofrecerán algunas aclaraciones y propuestas formales de definición sobre tales nociones (...) desde la filosofía de la ciencia del astrofísico y filosofo Gustavo Esteban Romero (G. E. Romero). En concreto se ensayaran unas definiciones formales de “teoría” y “modelo”, para las ciencias actuales (y otras disciplinas pasibles de su aplicación), y se contextualizarán estas ideas en el debate sobre la estructura y organización de los saberes científicos. En su libro Una ética sin fundamentos, Nicolás Zavadivker sostiene que la teoría ética y metaética de Mario Bunge pretende fundamentar las normas morales en premisas fácticas, sin hacer uso de valores. El presente trabajo discute esa tesis y sostiene que la teoría de Bunge busca construir y evaluar un sistema de valores y de normas, de forma rigurosa y sin arbitrariedad, a partir de conocimientos fácticos y valores de los evaluadores. Dado que la teoría de Bunge incluye valores entre (...) sus premisas argumentativas, es incorrecto categorizarla como una posición fundacionista que prescinde de valores. (shrink)

Este trabajo tiene por objeto analizar la noción de ciencia jurídica de los profesores Carlos E. Alchourrón y Eugenio Bulygin. Ésta parte del presupuesto de que la ciencia jurídica no está autorizada a crear nuevo Derecho, sino que sólo puede aspirar legítimamente a representarlo de alguna manera. Eso no significa que la suya sea una actividad meramente especulativa, en el sentido etimológico del término. Esto es, la ciencia jurídica no se limita a reflejar, como en un espejo, el Derecho tal (...) y como se nos presenta empíricamente, sino que confiere a éste un importante valor añadido a través de su sistematización. La primera parte de este trabajo está dedicada a exponer el modelo científico propuesto por los mencionados autores. En la segunda parte se presta especial atención a la cuestión de la separación entre descripción y prescripción en la actividad de la ciencia jurídica. Por último, en la tercera parte se cuestiona la utilidad del modelo propuesto sobre la base de los postulados teóricos de que se le hace partir, a lo que se suman ciertas dificultades metodológicas. En el presente trabajo se utiliza el problema ético de la automatización en transportes y vehículos dotados de inteligencia artificial (IA) para un análisis crítico de las diferentes posiciones éticas y morales clásicas. Debido a la intersección de la IA con los campos de investigación de la bioética, la nomoética y la tecnoética, existe un hilo conductor en sus fundamentos. Además, se juzga necesario para este propósito, así como por rigurosidad, hacer uso de una cantidad mínima de herramientas formales y (...) exponer un proyecto de una teoría ética actualizada, sistémica y materialista, que sobrepase a sus sistemas rivales. Así, se pretende ofrecer las bases para una teoría alterna más fecunda y explicar cómo las posiciones éticas tradicionales pueden ser obsoletas, si no directamente inaplicables, para afrontar la automatización inteligente y problemas morales similares, en la actualidad. Según la teoría contemporánea, un sistema jurídico existe cuando es eficaz en general. Así, identificar las normas jurídicas válidas en tal sistema sólo requiere cumplir con los requisitos establecidos en su correspondiente regla de reconocimiento.**** De modo que ni en la cuestión de la existencia del sistema ni en la de la identificación de sus normas tiene que ver la de la moralidad del derecho. The Challenge from Cognitive Diversity (CCD) states that demography-specific intuitions are unsuited to play evidential roles in philosophy. The CCD attracted much attention in recent years, in great part due to the launch of an international research effort to test for demographic variation in philosophical intuitions. In the wake of these international studies the CCD may prove revolutionary. For, if these studies uncover demographic differences in intuitions, then in line with the CCD there would be a good reason to challenge (...) philosophical views that rely on those intuitions for evidential support. I argue that philosophical views that rely on demography-specific intuitions for evidential support need not be threatened by such findings. I first provide a detailed analysis of the epistemological principles driving the CCD and distinguish three formulations of this challenge. I then show that there are good reasons to reject all such formulations of the CCD. (shrink)

Digital COVID certificates are a novel public health policy to tackle the COVID-19 pandemic. These immunity certificates aim to incentivize vaccination and to deny international travel or access to essential spaces to those who are unable to prove that they are not infectious. In this article, we start by describing immunity certificates and highlighting their differences from vaccination certificates. Then, we focus on the ethical, legal, and social issues involved in their use, namely autonomy and consent, data protection, equity, and (...) international mobility from a global fairness perspective. The main conclusion of our analysis is that digital COVID certificates are only acceptable if they meet certain conditions: that they should not process personal data beyond what is strictly necessary for the aimed goals, that equal access to them should be guaranteed, and that they should not restrict people’s autonomy to access places where contagion is unlikely. We conclude that, if such conditions are guaranteed, digital COVID certificates could contribute to mitigating some of the most severe socioeconomic consequences of the pandemic. (shrink)

Cognitive theories claim, whereas non-cognitive theories deny, that cognitive access is constitutive of phenomenology. Evidence in favor of non-cognitive theories has recently been collected by Block and is based on the high capacity of participants in partial-report experiments compared to the capacity of the working memory. In reply, defenders of cognitive theories have searched for alternative interpretations of such results that make visual awareness compatible with the capacity of the working memory; and so the conclusions of such experiments remain controversial. (...) Instead of entering the debate between alternative interpretations of partial-report experiments, this paper offers an alternative line of research that could settle the discussion between cognitive and non-cognitive theories of consciousness. Here I relate the neural correlates of cognitive access to empirical research into the neurophysiology of dreams; cognitive access seems to depend on the activity of the dorsolateral prefrontal cortex. However, that area is strongly deactivated during sleep; a period when we entertain conscious experiences: dreams. This approach also avoids the classic objection that consciousness should be inextricably tied to reportability or it would fall outside the realm of science. (shrink)

Higher-order thought theories of consciousness attempt to explain what it takes for a mental state to be conscious, rather than unconscious, by means of a HOT that represents oneself as being in the state in question. Rosenthal Consciousness and the self: new essays, Cambridge University Press, Cambridge, 2011) stresses that the way we are aware of our own conscious states requires essentially indexical self-reference. The challenge for defenders of HOT theories is to show that there is a way to explain (...) the required reference-fixing mechanisms that is compatible with the theory. According to Rosenthal, the reference to oneself as such is grounded in the disposition to identify the individual the HOT refers to as the individual who has that HOT. I argue that this leads to a vicious infinite regress on the more than plausible assumption that our cognitive capacities are limited. This leaves such theories without a foundation, since self-reference is thought essential to consciousness. (shrink)

The notion of the human embryo is not immutable. Various scientific and technological breakthroughs in reproductive biology have compelled us to revisit the definition of the human embryo during the past 2 decades. Somatic cell nuclear transfer, oocyte haploidisation and, more recently, human stem cell-derived embryo models have challenged this scientific term, which has both ethical and legal repercussions. Here, we offer a legal perspective to identify a universally accepted definition of ‘embryo’ which could help to ease and unify the (...) regulation of such entities in different countries. (shrink)

El objetivo de esta ponencia es abordar diversas temáticas propias de la filosofía wittgensteiniana desde una interpretación netamente pragmatista de las mismas. Concretamente, este será el caso del largamente debatido “argumento del lenguaje privado” (que desde una interpretación pragmatista no sólo conseguirá una mayor plausibilidad como tal argumento, sino que además será capaz de aportar luz sobre otros debates filosóficos contemporáneos en los que no siempre se detecta su íntima conexión con las cuitas wittgensteinianas); o la idea de parecidos de (...) familia (que sólo en un sentido pragmatista logrará escapar tanto de la vaguedad que le han achacado ciertas lecturas, como de cierta rigidez poco acorde, a todas luces, con las intenciones originarias de Wittgenstein); o la noción de “forma de vida” (que, por ejemplo, en la exégesis que el neopragmatista Richard Rorty hace de la misma, puede conectar así con otra de las nociones claves de otro pensador crucial del siglo XX, Martin Heidegger: se trata, en efecto, de la reflexión heideggeriana en torno a la Lichtung, a su vez conectable por parte de Rorty a la idea kuhniana de paradigma). Para finalizar, debatiremos brevemente la cuestión de hasta qué punto estas lecturas pragmatistas de Wittgenstein casarían con la imagen que el propio filósofo austríaco tenía de sí mismo como pensador. Resumen: Todo hecho debe ser narrado para ser objeto de examen valorativo. Pero este examen depende, en parte, de cómo aquél sea narrado. Algunos autores han señalado el valor democrático que posee el enfoque narrativo, en la medida en que permite que una narración sea construida a partir de diferentes puntos de vista. El problema es que estos puntos de vista pueden conducir a soluciones alternativas o incluso antagónicas, fenómeno no infrecuente en una sociedad multicultural como la nuestra. Desde un (...) punto de vista estrictamente narrativo, el mejor relato es el más persuasivo. Pero esto nos aboca al relativismo, puesto que la eficacia de un relato está en función del auditorio ante el que se argumenta. En este trabajo se ha intentado poner de manifiesto que sólo se alcanza a comprender la verdadera contribución de la narrativa si nos situamos, no tanto en el plano de los hechos, como en el plano de la normatividad. La tesis que aquí se sostiene es que la utilidad del enfoque narrativo está en función del valor arquetípico del modelo o estándar de conducta que eventualmente contenga una determinada narración. Entronca así directamente con la noción de razón práctica, más allá de sus específicos puntos de conexión con algunas de las metodologías bioéticas más importantes. Abstract: Every fact must be narrated in order to be subject of value judgement. But this value judgement depends partly on how that fact is narrated. Some authors have highlighted the democratic value of the narrative approach, because of its admission of different points of view to construct a story. The problem is that these points of view can easily lead to alternative solutions o even opposing ones. This phenomenon is not rare in our multicultural society. From an strictly narrative point of view, the best story is the most persuasive. But this lead us to relativism, because the efficacy of an story relies on the audience towards the argumentation is developed. In this work we have tried to bring to light that the genuine contribution of the narrative approach is not achieved if we stay on the level of facts and we do not pass to the level of normativity. We suggest the thesis that the utility of narrative approach is a function of the archetypical standard of behavior that a story may content. So this approach, beyond its specific connections with some of the most prominent bioethical methodologies, become directly connected with the notion of practical reason. (shrink)

Many philosophers and scientists have argued that the difference between phenomenally conscious states and other kind of states lies in the implicit self-awareness that conscious states have. Higher-Order Representationalist theories, attempt to explain such a self-awareness by means of a higher-order representation. Consciousness relies on our capacity to represent our own mental states, consciousness depends on our Theory of Mind. Such an ability can, at least conceptually, be decomposed into another two: mindreading and metacognition. In this paper I will argue (...) that consciousness cannot depend on mindreading. The tenability of HOR theories depends, therefore, on the relation between mindreading and metacognition. I analyze several views on such a relation and argue that none of them seem to be a plausible option for HOR theories. (shrink)

The methods of philosophical consultation vary enormously according to the practitioners who conceive and apply them. In this paper, we discuss the conceptions and methods we have been carrying out for several years in this field, such as philosophical naturalism, the dual requirement, first steps, anagogy and discrimination, thinking the unthinkable, switching to the "second floor", and being philosophical. Our methodology is mainly inspired by the Socratic maieutic, where the philosopher questions his interlocutor, invites him to identify the stakes of (...) his discourse, to conceptualize it by distinguishing key terms in order to implement them, to problematize it through a critical perspective, to universalize its implications. This practice has the specificity of inviting the subject to move away from a mere sensation to allow him a rational analysis of his speech and of himself, a sine qua non condition for deliberating on the cognitive and existential stakes which must be made explicit at first. The removal from oneself that this unnatural activity presupposes, for which it requires the assistance of a specialist, poses a certain number of difficulties, e.g., frustration, speech as a pretext, the issue of truth, pain and epidural. Finally, some additional exercises are very useful for the reflection process, such as establishing connections, real speech, order, universal and singular, and accepting the pathology. (shrink)

The traditional approach in cognitive sciences holds that cognition is a matter of manipulating abstract symbols followingcertain rules. According to this view, the body is merely an input/output device, which allows the computationalsystem—the brain—to acquire new input data by means of the senses and to act in the environment following its com-mands. In opposition to this classical view, defenders of embodied cognition (EC) stress the relevance of the body inwhich the cognitive agent is embedded in their explanation of cognitive processes. (...) From a representationalist frameworkregarding our conscious experience, in this article, I will offer a novel argument in favor of EC and show that cognitionconstitutively—and no merely causally—depends upon body activity beyond that in the brain. In particular, I will arguethat in order to solve the problem derived from the empirical evidence in favor of the possibility of shifted spectrum,representationalist should endorse the view that experiences concern its subject: the content of experience isde se.Ishow that this claim perfectly matches the phenomenological observation and helps explaining the subjective characterof the experience. Furthermore, I argue that entertaining this kind of representation constitutively depends on bodilyactivity. Consequently, insofar as cognition depends on consciousness, it is embodied. (shrink)

Representations are not only used in our folk-psychological explanations of behaviour, but are also fruitfully postulated, for example, in cognitive science. The mainstream view in cognitive science maintains that our mind is a representational system. This popular view requires an understanding of the nature of the entities they are postulating. Teleosemantic theories face this challenge, unpacking the normativity in the relation of representation by appealing to the teleological function of the representing state. It has been argued that, if intentionality is (...) to be explained in teleological terms, then the function of a state cannot depend on its phylogenetical history, given the metaphysical possibility of a duplicate of an intentional being that lacks an evolutionary history. In this paper, I present a method to produce, according to our current knowledge in genetic engineering, human-like individuals who are not the product of natural selection in the required sense. This variation will be used to shed light on the main replies that have been offered in the literature to the Swampman thought experiment. I argue that these replies are not satisfactory: representations should better not depend on natural selection. I conclude that a non-etiological notion of function is to be preferred for characterizing the relation of representation. (shrink)

This article develops a constructive criticism of methodological conventionalism. Methodological conventionalism asserts that standards of inductive risk ought to be justified in virtue of their ability to facilitate coordination in a research community. On that view, industry bias occurs when conventional methodological standards are violated to foster industry preferences. The underlying account of scientific conventionality, however, is problematically incomplete. Conventions may be justified in virtue of their coordinative functions, but often qualify for posterior empirical criticism as research advances. Accordingly, industry (...) bias does not only threaten existing conventions but may impede their empirically warranted improvement if they align with industry preferences. My empiricist account of standards of inductive risk avoids such a problem by asserting that conventional justification can be pragmatically warranted but has, in principle, only a provisional status. Methodological conventions, therefore, should not only be defended from preference-based infringements on their coordinative function but ought to be subjected to empirical criticism. (shrink)

Una de las tesis que tradicionalmente han sido defendidas por la tradición del positivismo jurídico es la tesis coactiva, según la cual el derecho consiste en un conjunto de normas coactivas, en el sentido de impuestas por medio de la fuerza. Pero, sin abandonar esta corriente, ha habido históricamente diversas maneras de entender las relaciones entre derecho y fuerza. Si, pues, hasta comienzos del s. XX era opinión común la idea de que el derecho constituía un conjunto de mandatos o (...) normas de conducta cuya eficacia se garantizaba a través de la amenaza del uso de la fuerza coactiva a los transgresores de aquéllas; a lo largo del siglo pasado, empero, algunos autores muy destacados dieron en sostener la opinión de que la fuerza disponible por jueces y funcionarios venía a constituir sustancialmente el objeto mismo de toda regulación jurídica. Según esta última concepción, el derecho tendría primordialmente la función de articular las condiciones de legitimidad para el uso de la fuerza, designando a los sujetos a los que se encomienda tal uso y determinado los casos y modalidades en los que pueda utilizarse. Entre quienes sustentan la primera tesis, que afirma que la fuerza constituye la garantía del derecho, es lugar común citar a Austin y, a menudo, se cita también a Jhering. Entre los defensores de la segunda tesis común es habitual mencionar a Kelsen, Olivecrona y Ross, habiéndose sustanciado una polémica entre Bobbio y Olivecrona en punto a determinar si fuera menciona Olivecrona o fue Kelsen el primero en adoptarla. Sin embargo, es problemático incluir a Jhering dentro del primer grupo y no dentro del segundo, en cuyo caso habría que atribuirle la primera formulación histórica de la tesis. Este trabajo, de carácter histórico, parte de la citada polémica y trata de verificar la constancia de la segunda tesis en las obras no sólo de Kelsen y Olivecrona, sino sobre todo de Jhering. Dual-process theories of higher order cognition (DPTs) have been enjoying much success, particularly since Kahneman’s 2002 Nobel prize address and recent book Thinking, Fast and Slow (2009). Historically, DPTs have attempted to provide a conceptual framework that helps classify and predict differences in patterns of behavior found under some circumstances and not others in a host of reasoning, judgment, and decision-making tasks. As evidence has changed and techniques for examining behavior have moved on, so too have DPTs. Killing two birds (...) with one stone, Evans and Stanovich (2013, this issue) respond to five main criticisms of DPTs. Along with addressing each criticism in turn, they set out to clarify the essential defining characteristics that distinguish one form of higher order cognition from the other. The aim of this commentary is to consider the defining characteristics of Type 1 and Type 2 processing that have been proposed and to suggest that the evidence can be taken to support quantitative differences rather than qualitatively distinct processes. Although religious belief is often claimed to help with physical ailments including pain, it is unclear what psychological and neural mechanisms underlie the influence of religious belief on pain. By analogy to other top-down processes of pain modulation we hypothesized that religious belief helps believers reinterpret the emotional significance of pain, leading to emotional detachment from it. Recent findings on emotion regulation support a role for the right ventrolateral prefrontal cortex, a region also important for driving top-down pain inhibitory circuits. (...) Using functional magnetic resonance imaging in practicing Catholics and avowed atheists and agnostics during painful stimulation, here we show the existence of a context-dependent form of analgesia that was triggered by the presentation of an image with a religious content but not by the presentation of a non-religious image. As confirmed by behavioral data, contemplation of the religious image eneabled the religious group to detach themselves from the experience of pain. Critically, this context-dependent modulation of pain specifically engaged the right VLPFC, whereas group-specific preferential liking of one of the pictures was associated with activation in the ventral midbrain. We suggest that religious belief might provide a framework that allows individuals to engage known pain-regulatory brain processes. (shrink)

Este trabajo gira en torno al casuismo. Se hace hincapié en su necesidad para la ética biomédica. A través de su carácter analógico, se pone de manifiesto, a su vez, su dependencia de los principios. Sin embargo, ni principios ni casos bastan por sí solos para iluminar completamente las decisiones biomédicas, que presentan un notable componente de incertidumbre. Una decisión no es un objeto preexistente, sino algo que hay que producir, un operable. Aquí se pone de manifiesto que esta realidad (...) no se puede abordar si no es a través de la noción clásica de prudencia, en el sentido de la phrónesis aristotélica. Una vez esbozada ésta en sus líneas generales, dando cuenta de sus aspectos morales e intelectuales, es posible enfocar de nuevo el casuismo con nueva luz, superar las críticas más importantes y comprender que la relación clínica es también una relación jurídica, por lo que el papel del Derecho, y en particular el de la jurisprudencia, se muestra vital. Some philosophers, like David Chalmers, have either shown their sympathy for, or explicitly endorsed, the following two principles: Panpsychism—roughly the thesis that the mind is ubiquitous throughout the universe—and Organizational Invariantism—the principle that holds that two systems with the same fine-grained functional organization will have qualitatively identical experiences. The purpose of this paper is to show the tension between the arguments that back up both principles. This tension should lead, or so I will argue, defenders of one of the principles (...) to give up on the other. (shrink)

Como es sabido, en el ámbito de la ética biomédica, se han formulado diversas propuestas metodológicas que tratan de ofrecer una serie de pautas para la toma de decisiones. Estas metodologías son útiles, en la medida en que aportan criterios, pero son esencialmente insuficientes. En efecto, tomar una buena decisión requiere un tino especial, que va más allá de la mera técnica, y que tradicionalmente se ha denominado prudencia. No en el sentido más común y periférico de precaución, sino en (...) el sentido más central de phrónesis o prudentía. Aunque no es una noción nueva, sí se trata de una noción que suele aparecer desdibujada, ocupando un lugar equivocado, marginal o indefinido en la teoría de la toma de decisiones biomédicas. A partir de esta constatación se pretende dos cosas. En primer lugar, señalar la necesidad de comprender el papel troncal que tiene la prudencia en el ámbito de la toma de decisiones, para lo que se partirá de algunas de las metodologías más influyentes en nuestro entorno. Y, en segundo lugar, recuperar los colores originales de la noción aristotélica de prudencia. Por razones de espacio, en el presente trabajo la segunda cuestión es sólo parcialmente abordada. (shrink)
